Rules of Conduct

Did the Sisters of Assisi become victims of the unfair and unethical business practices known by African Americans, other People of Color and the Work Challenged when dealing with Commissioner Rocky Marcoux, RACM board, City Planning Commission, assessors office, city attorney office and the elected officials (mayor Tom Barrett, Common Council) at 200 E. Wells - City Hall.  Exploitation, discrimination, disenfranchisement are especially true when dealing with African Americans in the city of Milwaukee.

Did the Sisters forget their Mission?
Did they think about the Golden Rule?  
Did they consider TRUST as an amount not purchased or bought with favor, but earned?  
Did they render to the Amani People RESPECT-4-RESPECT?
Did they come to the Amani Neighborhood and engage extensive dialog and communication, goodwill and good faith before rounding up individuals that would be toxic and alien to success?

We say, they may have been duped by Marcoux and others, but they have been around long enough for appropriate administration - Code of Conduct - of their affairs.  Therefore, a great deal of this error falls on the shoulders of the Sisters of Assisi and Sister Edna Lorengan.

So here comes another land-people-resource fleecing of Amanians that violates their rights and adds insult to injury by the city of Milwaukee elected-appointed-hired employees.  

This time after 19 years of "fail-to-deliver" Phase I, II, III, and IV- Boldt and Irgens Development - North Avenue Commerce Center fiasco.

This time, after huge revenue streams of empowerment given/lavished-on every Caucasian Tom, Dick, Harry, Sue Sally and Jane during the NO-SHOW promised investment; and, obviously unforgettable "mishandling" of Milwaukeeans' resources for the North Avenue Commerce Center; Amanians, contiguous neighbors and all Milwaukeeans are presented another "susprise" gift-wrapped TROJAN horse with revenue on the backs of Amanians and BAIT-N-SWITCH components.

Elected-appointed-hired representatives orchestrated with straight faces a violation of the 14th Amendment and other human-civil-legal laws by failing to get permission and following existing rules and regulations that help guarantee "due process".


The Fourteenth Amendment to the U. S. Constitution reads:
Section 1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

Based on what has transpired, Commissioner Rocky Marcoux and team abandon their roles and responsibilities to the U.S. Constitution as the Department of City Development for the city of Milwaukee.


The mission of the Department of City Development (DCD) is to improve the quality of life in Milwaukee by guiding and promoting development that creates jobs, builds wealth and strengthens the urban environment, and at the same time respects equity, economy and ecology.

To fulfill this mission we:

  • Build on the city's competitive advantages, including its built environment, natural setting, diversity and status as a center of commerce and culture

STATUTE VIOLATIONS - OATH VIOLATIONS
3-01. Mayor. The mayor shall take care that the laws of the state and the ordinances of the city are duly observed and enforced; and that all officers of the city discharge their respective 
duties.

Every person elected or appointed to any office established by the city charter shall, before he enters upon the duties of his office, take and subscribe the oath of office prescribed in the constitution of this state, and file the same duly certified by the officer administering the same with the clerk of the city. 

Before entering upon the duties of his office, the treasurer shall be covered by a bond executed to the city of Milwaukee in such sum and containing such conditions requiring the faithful discharge of the duties of his office as the common council may require. The common council may from time to time require new and additional bonds from the treasurer and may remove him from office for refusing or neglecting to give proper bonds. The common council may also require that other officers and employes be covered by faithful performance or honesty type bonds, either in individual form or under a blanket bond, or both, the cost of which bond may be paid by the city. 

All aforesaid bonds shall be filed in the office of the city clerk.

CHAPTER 19 - Wisconsin Statutes
GENERAL DUTIES OF PUBLIC OFFICIALS

The mayor, common council and DCD commissioner have allowed the law of DUE PROCESS to run amuck.  They have created a pattern/culture of exploitation, discrimination, conflict of interest and failed due process which has created disenfranchisement of Amanians, African Americans and other People of Color in the execution of the North Avenue Commerce Center, Phase I, II, III, and IV - Boldt and Irgens Development; and, the Sisters of Assisi St. Ann's project

They (elected officials) have failed to monitor with fiduciary oversight according to the U.S. Constitution and state laws; their Oath, and, thereby have a culture in place that disregards due process through omissions, deception, lock step pre-agreements, commandeering, lack of communication, lack of timely communication and lack of needed financial packaging and engagement. 

Commissioner Marcoux, appointed city planning commission, appointed RACM board members and staff have been allowed to run "without discretion" and without accountability when providing land  and resources customer care services to African Americans - over 40% of Milwaukee's population, and a primary federal resource contributor to the economic development and quality of life pool for Milwaukee - paid taxes, government funding and federated funding.
Marcoux has failed the mission and have been complicit in non-transparency, following statute and lack of best practices.  The level of wrongdoing by commissioner Marcoux accounts for dereliction of duty on his watch. His failure to provide due process through his assigned department has contributed to the city of Milwaukee not providing economic development and quality of life benefits  promised to its taxpayers and stakeholders; and, puts TRUST at risk and calls for immediate address by the mayor and common council.

DCD (commissioner and staff), City Planning Commission (appointed by the mayor) and RACM (board appointees by mayor Barrett) have been given powers to reach-out to Milwaukeeans, hear their desires, create ways and means and buy-in with them individually and as a group, for the creation of good for the city of Milwaukee.  They, DCD, City Planning and RACM, have failed through several ways, i.e., conflict of interest, misrepresenting the availability of property, due diligence in review enforcement, divisiveness, exploitation and pitting one-against the other while engaging Milwaukeeans land, funds and resources in a prejudicial and discriminatory way.

Since Marcoux, staff and appointed boards and committees had check points by Mayor Tom Barrett and the Common Council (1990-now), and the mayor and common council are the two statute guardians of the people, Barrett and the common council are tagged with responsibility for ALL corrections during their watch.

For those who may not know, it is important to note, people of Amani and real stakeholders are finding out in 2014 about this 4-year old  engagment (according to Sister Edna Lonergan  on March 18, 2014).  The problem with Sister Lonergan statements of outreach to intricate Amanian taxpayers, stakeholders and leaders, they are the main ones that have no idea of the use of the land; and, have not been approached by ex-alderman Hines, mayor Barrett, common council members, commissioner Marcoux and staff.

This type of bad government relations has NO place here.  Milwaukee has egregious race inflictions that must be met in civil court and criminal court.   No one is exempt.

St. Ann Intergenerational Center and friends (Bucyrus), C.G.Schmidt, Zimmerman Architect, Bow Partners, Next Door Foundation, Parklawn Church and American Design), using funds on the backs of the Amani and contiguous neigborhoods to drive and sustain revenue, a flawed donor-for-hire representative, reminder of shunned gentrification and staging sends the wrong message.  It overshadows any good that could be rendered here.

The damage is recognized but the idea of services being offered is not new.  We, the People, have and have had ideas, ideas that were and would be supported by residential and commercial stakeholders.  However, like slavery of African American in times before, the opportunity was not presented,  was taken - misrepresented - exploited.

The sabotage and incorrect double-triple standards by our city government MUST stop now by selected means that are necessary.  The court system in a class-action suit is an option of recourse as well as term limits in 2016 for those in office for city government.

Background
This is not the first time that the leadership of DCD (Marcoux, Penman and Morgan) have engaged in questionable and against-the-law behavior.

By the same token, Sisters of Assisi and their representatives must engage in integrity and ethical behavior that is expected in manners like this.  In other words, there have been many "red flags" that challenged the faith that the Sisters represent.  Why weren't they challenged?

Wednesday, March 18, 2014, St. Ann Intergenerational Center rolled-out the Project Introduction Meeting for the St. Ann Center for Intergenerational Care at Milwaukee Enterprise Center, 2821 N. 4th Street, Milwaukee, Wisconsin, Room 300.

The comments of Sister Edna Lorengan included giving the Mission of the Sisters of St. Francis of Assisi and St. Ann Intergeneration Center.   The mission tells us the people and reminds the Sisters of why they are there.  What happened?

Sister Lorengan, Dan Davis, CG Schmidt, Doug Barnes, Zimmerman Architects and JT Williams, American Design were on the Agenda.  
Pastor Walter Harvey - Parklawn Church
Pastor Walter Harvey, Parklawn Church, was seated upfront but not listed on the agenda.  With all due respect to Pastor Harvey, he was "window dressing" and "hype".  It turns out he had brokered a build-out deal for a band shell that did not include the Amani Neighborhood stakeholders.  Amani is the neighborhood St Ann is seeking to become part of.  His portion of sustainability was not presented at the Zoning, Neighborhood with authenticity and assurance.  At the March 18, 2014 meeting Davis of C G Schmidt mentioned that there would probably be "fundraisers" for the band shell.

Pastor Harvey’s band shell idea is devoid of his fellowmen of Amani.  There are four churches in the immediate stone-throw of where the St. Ann site is proposed.  They are:
  • Hopewell Missionary Baptist Church
  • Going Up Yonder Church of God & Christ Community Church
  • Tabernacle Community Baptist Church
  • Monumental Missionary Baptist Church
There are many others right around the above 4.
These are also churches with different practices of faith from Catholic and have similar programs that are already in the area for children, seniors, education, etc.  

Duplication of services and lack of collaboration to maximize overall services is one of the strategic points that should have been addressed in the intial outreach for compatability.

Vicre President - Diversity & Inclusion - Wheaton Franciscan
Theresa D. Jones, Wheaton Franciscan Healthcare, African American and board member of St. Ann was brought upfront when Mary Glass, Chair/CEO, Milwaukee Professionals Association LLC asked Sister Lonergan, where were the people of the Amani Neighborhood – the board members and contractors.  Jones and Pastor Harvey are not from the Amani Neighborhood.   

Pastor Harvey did not explain his role; however, it seems to be disconnected from core funding by the St. Ann's project; lacking real funding given comment by Davis of raising funds later on.   Parklawn is one of the names on the signage below.

Gentrification when neighborhood stakeholders are not respected and identified as the main stakeholders.
Tim Sullivan, Bucyrus, is leading the capital campaign for St. Ann Center and has brokered a "naming rights" for the site - Bucyrus Campus.   Bucyrus Campus was not part of the introduction of the St. Ann Intergenerational Center for North Avenue. 
BAIT-N-SWITCH.

Bucyrus was not mentioned in the amendment by Janet Grau, recommendation by ex-alderman Hines, endorsement by alderman Willie Wade, or supervisor David Bowen.  St. Ann Campus was mentioned - Not Bucyrus Campus.

According to Andy Weigham - Bow Partners, at the Board of Zoning, Neighborhood & Development meeting (when asked by alderman Michael Murphy about funding) - Weigham said the funding for the St. Ann Center proposed for North Avenue would be 100% public funding.

So, what's the "cloak-and-dagger" and throw-in gentrification of Tim Sullivan and Bucyrus (Chair and past chair of board at St. Ann Center) about?  Out-of-order.  BAIT-N-SWITCH.

"As a 68 year old African American, business owner, Amani Neighborhood strategic planner and channel developer, protagonist for the human-civil-legal rights of all and 0ver 36 years as a Catholic, member of the Cathedral of St. John the Evangelist, the Sisters must do what is right here.  They have allowed something to get in their eye and their heart that must be corrected. Is it liken to the 30 pieces of silver, said Mary Glass, Chair/CEO, Milwaukee Professionals Association LLC.

Sullivan is part of the"monopoly-oligopoly" MMAC/Milwaukee Metropolitan Association of Commerce and the Milwaukee 7, who have created the exclusive club of trapping resources of Milwaukee through mayor Tom Barrett and ex-Alderman Willie Hines for corporate welfare using resources of the City of Milwaukee saying one thing and doing another.   BAIT-N-SWITCH.

Texas officials matched Bucyrus International with a ready-to-occupy factory in Kilgore.
Sullivan, CEO,  Bucyrus International is the one who was given access to the full curriculum of MATC/Milwaukee Area Technical College for welders and he exploited the privilege with media hype, demeaning MATC and the selling out  and moving Bucyrus plant jobs to Kilgore, TZ.

Not long after this, MATC welding instructor Larry Gross wrote an op ed for the Journal Sentinel where he claimed that MATC worked with Bucyrus to create “a customized curriculum” to help students pass the Bucyrus welding test. He also noted that Kilgore offered $540,000 in incentives to the company to a build a plant there.   The World According to Tim Sullivan

Blaming MATC is off the mark

Sullivan also cited metro Milwaukee schools for the shortage, implying that Texas high schools have a better record. Not true. Metro Milwaukee's high school graduation rate is almost eight percentage points higher than Kilgore's. And college graduation rates are over 10 points higher here.
The skilled labor shortage, contrary to Sullivan's assertion, is a national problem that includes Texas. According to the government study Texas Works 2008 Training and Education for All Texans, Texas businesses "face shortages of skilled workers. Employers in and near the cities of Corpus Christi, Port Arthur, Beaumont and Texas City report that they cannot find enough welders."
The solution to Wisconsin's shortage is simple:  Support technical education in high schools and get more resources to Wisconsin's technical colleges that train the skilled workforce.
Instead of blaming MATC, the government body that has worked overtime to help his company, Sullivan should be expressing outrage at Gov. Scott Walker's budget, which decimates Milwaukee Public Schools and cuts the state's contribution to MATC and other tech colleges by 30%.

Bucyrus Campus - Lack skin in the game and Flawd
Sister Lorengan gave the razzamatazz staging using the impressive rendering as the convincing backdrop to score points for proposed services of the Intergenerational center that bears the name of a “donor-for-hire” – Bucyrus Campus (a gentrification practice shunned since it displace history of real stakeholders and place in history Caucasian individuals with no history but buying history with race, money, cronyism and power broking).

Sister Lorengan not only brought promised health care and childcare but the NEW center would bring amenities not seen to date in the area but asked and not supported by the city of Milwaukee.  

In the past, ex-mayor John Norquist, ex-DCD commissioners Michael Morgan and Julie Penman; ex-alderman Fred Gordon, ex-alderman Willie Hines, now mayor Tom Barrett and now commissioner Rocky Marcoux a reputation of discriminatory acts, cronyism, self-serving behavior and failing to include and respect African Americans.  This was recently seen in DCD commissioner Marcoux debacle and city embarrassment with the Dollar Tree vs stakeholders’ grocery site at North and MLKing Drive.

Genrification
Gentrification is typically the result of "proposed corporate type investment with-no-teeth enforcement  by local government or corporate business groups and can often attract national businesses, moving out small local businesses that hire from the neighborhood, and benefit corporate interests rather than neighborhood community work.

Donor-for-hire, such as Bucyrus with St. Ann is frowned upon.  
It allows Caucasians and individuals with money to excite elected-appointed-hired individuals as well as invite pessimists to sign away rights and privileges of those who have not done their due diligence and vetting with Amanians.

Sister Lorengan promised over 300 jobs (a familiar promise by the city of Milwaukee and ex-alderman Fred Gordon to get the land originally from the owners/stakeholders of the Amani Neighborhood). 

Continually the land has come up with Caucasian projects with a promise of JOBS.  Yet the area continues to grow in increased poverty and remains in Enduring Concentrated Poverty.  Too often due to imported employees, BAIT-N-SWITCH and failed enforcements.

This has been seen with Steeltech, Capitol Stamping, Boldt Development, Irgens Development (Mark Irgens)Goodwill Industries, Private Industry Council, Lutheran School, ex-alderman Fred Gordon, ex-alderman Willie Hines and many more with NO SHOW).  Mark Irgens had the four phases (24th – 27th street on North Avenue) the longest.   According to records, he was paid at least $200,000 per year by the city of Milwaukee whether he developed or not. 

Before jumping ship, Irgens sold Phase I (Gerard Randall - Private Industry Council) & Phase II (Sally Peltz - Legacy Redevelopment Corporation).  

Phase III and IV was left NULL & VOID – Amanians have been held hostage with refusal of use, lack of response, no response and cover-ups  for 19 years; now St. Ann.

Supervisor David Bowen - 10th District
The $$dollar amounts and promise of jobs tend to trigger irresponsible responses and photo opts with UNINFORMED or DO NOT CARE elected officials.  Their off-the-cuff hypocracy have been damning, far from the facts, seen as self-serving and aimed to sway.   Such a comment followed by photo with Sister Lonergan was made by Supervisor David Bowen, 10th District during the rollout and elected official support.

He was quickly reminded by Mary Glass, Chair/CEO, Milwaukee Professionals Association LLC to do his homework – get the facts before speaking and failing to represent the people of the 10th District that looked like him.

Glass said, “it is this type of shooting-from-the-hip by elected-appointed-hired government representatives that has held the land hostage, perpetuated discrimination, invited exploitation, perpetuated enduring concentrated poverty; and giving the 7.5 acres for $1 without the input and agreement of the Amani Neighborhood stakeholders.”

Sister Lorengan’s rollout was beguiling for the listeners with the 7-acre site, 80,000 sq. ft., she got for $1 that has been held hostage by the city of Milwaukee.  She went to Commissioner Rocky Marcoux and received the blessings of mayor Barrett, ex-alderman/Common Council President Willie Hines and the Common Council (all except Alderman Bob Bauman) the land that was not theirs to give without the acknowledgement and decision of the stakeholders of the Amani Neighborhood.

On March 18, 2014, it was clear by the questions from the floor by the African American contractors who are lire of this project given the track record of our elected-appointed-hired representatives, Boldt, Irgens Development and others, that comments by Dan Davis, CG Schmidt and Sister Lonergan, St. Ann were not grounded in due diligence of inclusion of African American, other People of Color and Work Challenged stakeholders.

What was evident was the traditional add-on aesthetics to give the appearance of “inclusion” of African American.  This includes the use of African American JT Williams, American Design Inc for MBE, WBE, and DBE participation as well as Pastor Harvey of Parklawn Church.  As a rule, the MBE, WBE and DBE fair well for Caucasian women and their partners.

Sister Lorengan, St. Ann, Bucyrus, CG Schmidt, Zimmerman and Bow Partners represents an UN-inclusive Project and staged development using the assets of Amanians - land, funded resources, fund development matched with guaranteed Medicaid and Medicare benefits. 

The fact that the Sisters of Assisi failed to come in good faith and talk to Amani about coming to the Amani Neighborhood, asking questions for vetting, collaborations, entrepreneurship, ownership, scholarship, apprenticeship, fellowship, citizenship and stewarship in a "WE the People" format, especially since the Sisters plan was based on use their land, resources and people to fund and underwrite 100% of the project; they failed community relations, pre-primer respect and their plan.   
   

Why C G Schmidt?  What were the prerequisites of hire for the Sisters of Assisi, St. Ann project for the Amani Neighborhood?  This is a company that is seen as monopoliy-oligopoly and UN-INCLUSIVE.

This is a company that is well-trenched.  Yes.  Well-trenched with cronies that use massively Milwaukee funding (again brought in on the backs of the population - who make up 3/4 of the population) but are denied contracts - prime and subcontractors.

C G Schmidt had a multi-year development for St. Mary's Hospital on the East Side of Milwaukee recently.  Whenever I passed the site, everyone working were Caucasian males.  What's that about when Milwaukee has contractors and have a high unemployment rate.  Why must it be "SET-ASIDES" for INCLUSION?

C G Schmidt has a huge contract with the public University of Wisconsin - Milwaukee, basically NO African American working.  What's that about?

When Milwaukee Professionals Association LLC sought public information, the head representative of CG Schmidt, refused to respond and blocked email.  That is arrogance and it certainly does not rub well to see them here in Amani and at the rollout with "not a clue" of involvement of African American contractors - lack of integrity here.  Lack of respect. 

Too often you will hear irresponsible and unacceptable statements of they could not find certified and/or contractors with specificity; why haven't they (prime contractors, developers, architect, etc.) gone to the city of Milwaukee (Tom Barrett and Common Council) to change this? 

So, the first group we see again is a Caucasian firm with "too-much" say-so about the assets of Amanians and Milwaukeeans in the majority, African American and other People of Color.
